All clients must read and agree to the terms below before engaging the studio on any project.
Last updated: 2026. By entering into a business relationship with Kiar Elias Novar (the "Studio"), you (the "Client") consent to the following terms and conditions in full. These terms govern all project engagements, deliverables, and communications between the Studio and its clients.
Studio working days are Monday through Friday, 9am to 6pm Pacific Time, excluding BC and Canadian statutory holidays.
The Studio makes all reasonable efforts to deliver concepts and revisions to the Client within the timeframes agreed upon during initial consultation. If higher project volumes affect scheduling, you will be notified at the earliest opportunity with an updated timeline.
Deliverables will be shared with the Client via a secure file-sharing link for review. The Client will provide feedback on the draft within the agreed window. The Studio will then apply revisions and resubmit as needed.
Once the Client has approved the final deliverable, any outstanding balance must be settled before final files are released. The Studio does not maintain an archive of Client project files beyond 60 days post-delivery. Clients are responsible for downloading and storing all files.
The Studio creates original work and makes every effort to ensure that all designs are legally distinct and do not infringe on existing intellectual property. If a design unintentionally infringes on an existing trademark, the Studio's liability is limited to a free revision to make it legally distinct, or the option to commission a new design at a negotiated rate.
The Client guarantees that any design elements, text, graphics, photos, or brand assets provided to the Studio do not violate any copyright or trademark laws. The Studio will not be held responsible for any legal action arising from improper Client-provided materials.
The Studio retains the right to display completed work in its portfolio and on its website, unless exclusion is explicitly requested and confirmed in writing prior to project commencement.
All revision requests must be submitted to the Studio in writing by email. Revisions may be discussed verbally, but no work will commence until written confirmation is received.
Unless otherwise agreed in writing, the Studio provides one major revision stage and two minor revision stages per deliverable. Revision requests must be submitted within seven (7) days of receiving the proof. After this window, the submitted proof is considered approved. Any revisions beyond this point are subject to additional fees.
If revision requests exceed the agreed scope, the Studio reserves the right to apply an additional hourly rate, with notice provided to the Client before work begins.
Creative production involves significant specialization and expertise. Project quotes are estimates only, unless otherwise specified in a signed contract. Final invoices will not exceed the quoted amount by more than 5% without prior written authorization from the Client.
Projects under $1,000 CAD are invoiced in full before work begins. Projects over $1,000 CAD require a 50% deposit before commencement, with the balance due upon delivery of final files. All work remains the intellectual property of the Studio until payment is received in full.
Payments are accepted via e-transfer (Interac), credit card, PayPal, bank/wire transfer, or certified cheque. Canadian clients are invoiced in CAD. All other clients are invoiced in USD.
All invoices are due within 7 days of receipt. After 30 days, a 2% late fee is applied to the outstanding balance. After 60 days, an additional 2% is applied. Accounts remaining in default after 60 days will receive a final written warning before being referred to a collections agency or legal authority.
A project is considered abandoned after 60 consecutive days of no client communication. Deposits on abandoned projects are non-refundable. Renewal of an abandoned project requires a new agreement, fee schedule, and deposit.
The Studio is committed to protecting Client privacy and operates in accordance with applicable Canadian privacy legislation.
Any account credentials, FTP access, domain registrar information, or other sensitive data provided to the Studio will be kept strictly confidential and used solely for the purposes established in writing.
Project files, communications, and account information are stored on secure encrypted servers. The Studio uses all reasonable precautions to protect Client data, but cannot be held responsible for third-party security breaches beyond its control.
The Studio does not sell, share, or distribute Client information to any third parties except where required by law.
By engaging the Studio for any project or service, you consent to the terms specified on this page. The Studio reserves the right to update these Terms and Conditions at any time. The version published on this page is always the current and authoritative version.
